With Legislative Decree 31.10.2025 no. 159, published in the Official Gazette 31.10.2025 no. 254, urgent provisions on health and safety protection in the workplace have been enacted. The decree entered into force on 31.10.2025.
DL 159/2025 is currently being converted into law and its provisions are subject to amendments and additions.
Digital construction site badge
Article 3 of DL 159/2025 supplements the rules for the identification card (known as “construction site badge”) required for employees of companies operating on construction sites under contracts or subcontracts. The card will also be applicable to additional higher-risk activity areas, to be identified by subsequent ministerial decree.
The card, used as a badge, must be equipped with a unique anti-counterfeiting code and indicate the employee’s identifying information. It will also be made available in digital format through national tools interoperable with the SIISL platform (Information System for Social and Employment Inclusion). The digital badge will be automatically produced and pre-filled, subject to additions by the employer.
Changes to the points-based license
For the points-based license of companies and self-employed workers operating on temporary or mobile construction sites, the measure introduces:
Points deduction procedure
For cases of maximum penalty for undeclared work, it will no longer be necessary to wait for the final injunction order: notification of the inspection report will be sufficient. The new regulation applies to offenses committed from 1.1.2026.
Administrative penalties
For companies or self-employed workers operating on construction sites without a points-based license or with fewer than 15 points, the administrative penalty (calculated at 10% of the work value) cannot be less than 12,000 euros, compared to the previous 6,000 euros.
Inspection activities on subcontracts
The National Labor Inspectorate (INL) must prioritize inspections of employers operating under subcontracting arrangements, public or private, within the framework of monitoring activities for issuing registration certificates in the “INL Compliance List”.
Revision of INAIL rates
INAIL is authorized to revise oscillation rates in bonus for accident performance and contributions in agriculture, effective from 1.1.2026. Companies that have received final conviction sentences for serious violations of workplace safety regulations in the last two years are excluded from bonus recognition.
Protection for students in work-school training
INAIL insurance coverage also applies to commuting accidents of students engaged in work-school training paths, occurring during travel from home to the activity location and vice versa.
Agreements signed for work-school training paths cannot provide for students to be assigned to high-risk work activities, as identified in the risk assessment document (DVR) of the host company.
INAIL scholarships
From 1.1.2026, INAIL provides annual scholarships to pupils and students, survivors of deceased persons due to work accidents or occupational diseases. The amounts are 3,000 euros (primary and lower secondary school), 5,000 euros (upper secondary school and vocational training) and 7,000 euros (university, AFAM and ITS Academy). Spending limit: 26 million euros per year.
Job posting on SIISL
From 1.4.2026, private employers requesting contribution benefits financed with public resources for hiring personnel must publish the availability of job positions on the SIISL System. Mandatory communications regarding establishment, modification and termination of employment relationships may also be made through SIISL.
