With the 2025 Budget Law (L. 207/2024), Article 1, paragraph 860, important changes have been introduced regarding digital domicile, affecting company administrators.
Main Updates:
- Obligation of PEC for Administrators: All company administrators must now have a certified email address (PEC), excluding certain entities like simple partnerships and mutual aid societies.
- Registration in the Business Register: Administrators’ PEC addresses must be registered with the Business Register.
- PEC Separate from the Company: The administrator’s PEC cannot coincide with the company’s PEC to ensure clear and direct communication.
- Single PEC for Multiple Positions: Administrators can use a single PEC address for multiple roles or separate addresses for each role.
Penalties for Omission:
Failure to communicate the PEC address will result in the inability to complete applications for registration or filing documents with the Business Register. The Chamber of Commerce will suspend the process, granting a maximum of 30 days to regularize the situation, after which the request will be rejected.
Required Action:
Therefore, we encourage you to verify the status of your company’s administrators and, if necessary, request a personal PEC address for each administrator, and promptly communicate it to our office through Gabriella Gradino at g.gradino@studiorcg.it to facilitate submission to the Business Register.
